H1B tracker : Latest News Updates, Bills, reforms Status

Over the last few years, sponsors introduced many H1-B related bills and executive orders in the house. Many people have asked me details about many a H1B bill and their status. Therefore, I thought, it will be a wonderful idea to track them all together in a single blog post.

Executive order 1: Buy and Hire American

  • Introduced by: The President
  • Date: April 18, 2017
  • Status: Signed

Summary

The new H-1B executive order states that all heads of departments will monitor and enforce buy American within 150 days of the order signed date.

The main crux of the order is the following.

  • All department heads should propose new rules and issue new guidance, to protect the interests of United States workers by prevention of fraud or abuse of working visas. In order to promote the proper functioning of the H-1B visa program, suggest reforms to help ensure that H-1B visas goes to the most skilled and highest paid petitioners.

H1B Bill 2: H.R.1303 – H-1B and L-1 Visa Reform Act

Summary

Bill aims to revise employer and government requirements regarding visas for non immigrants.  (H-1B and L-1)

 H-1B visa allocation system using the following rules.

  • First priority reserved for aliens with advanced STEM degrees from United States institutions.
  • The bill requires completion of a U.S. degree or an equivalent as a qualification for “specialty occupation” eligibility.
  • Eliminates experience in a specialty as an equivalent to the completion of degree.
  • Period of admission reduced from six to three years, with three-year extensions
  • Bill denies an H-1B visa to any alien normally classifiable as an H-1 non immigrant who seeks U.S. admission to provide services in a specialty occupation.

Bill establishes an L1 visa allocation system using the following rules.

  • Prohibits an employer from hiring for more than one year.
  • Be stationed primarily at the work site of an employer other than the petitioning employer.
  • No employer may replace a U.S. worker with an L-1 worker.
  • Improved wage rates and working conditions.

H1B Bill 3: High-Skilled Integrity and Fairness Act

  • Date: January 24,2017

  • Latest update: 02/08/2017 Referred to the Subcommittee on Immigration and Border Security.

Summary

Summary

The purpose of this Act is to close a loophole in the H-1B visa program by requiring H-1B-dependent employers once again to pay sufficiently high wages to ensure the protection of the workforce in the United States and to remove other impediments to proper H-1B visa enforcement. At an annual rate equal to at least the greater of $100,000 or the applicable adjusted amount.
